Actress pleads not guilty, could serve jail time here

KANE'OHE — A "Lost" actress on probation in California for drunken driving faces possible jail time in Honolulu for the same offense after she pleaded not guilty yesterday in connection with a Nov. 24 arrest in Kailua.

Mayte Michelle Rodriguez, 27, who plays Ana Lucia on the award-winning ABC drama, was arraigned in Kane'ohe District Court yesterday with fellow "Lost" cast member Cynthia Watros, 37, who was arrested with Rodriguez on Nov. 24.

Both women did not appear in court yesterday and were represented by their attorneys.

Rodriguez also faces up to 18 months in a California prison if a Los Angeles superior court judge decides that she violated the conditions of her release.

Rodriguez pleaded not guilty and is set to go to trial at 9:30 a.m. March 30.

Watros, who plays Libby on "Lost," asked that her arraignment be continued until Jan. 12, when she will be allowed to change her plea at 8:30 a.m.

Rodriguez's attorney, Steve Barta, declined comment. In court he asked for more time to "discuss" the case with the state.

Watros' attorney, Lanson Kupau, said his client is "remorseful."

"Cynthia realizes she made a mistake," he said after the proceedings yesterday. "This sends a clear message that you shouldn't drink and drive. She wants to get this over with and take responsibility for it."

Watros will plead guilty Jan. 12, he said.

Rodriguez has been charged in Honolulu as a two-time offender, said City Deputy Prosecutor Sean Sanada, meaning she faces up to 14 days in jail, fines up to $1,500, and the loss of her license for a year. She was charged as a repeat offender because she has a prior conviction in another jurisdiction for traffic offenses that include drunken driving.

Sanada declined to discuss details of the case.

On Dec. 21, Deputy Los Angeles City Attorney Tim Saito filed a motion to revoke Rodriguez's probation in Los Angeles superior court. Rodriguez or her attorney must go before a judge Jan. 24 in Los Angeles for a probation revocation hearing.

Saito said yesterday the judge will wait to see what happens with Rodriguez's case in Hawai'i before ruling on her probation.

"Until we see what happens in Hawai'i then we can make an assessment," said Saito in a telephone interview.

If the judge finds she violated her probation, she could face up to 18 months in jail, he said.

Rodriguez was sentenced to three years' probation June 4, 2004 and ordered to undergo a 30-day substance-abuse treatment program after pleading no contest to three misdemeanors in 2003 related to two different traffic incidents in Los Angeles, according to records filed in Los Angeles Superior Court.

The charges involved hit and run, property damage, driving with a suspended license and driving under the influence with a blood-alcohol level above .08, the records show.

Both women are free on $500 bail each.
