An O'ahu grand jury yesterday indicted a 50-year-old Newtown man on multiple sex assault charges in connection with alleged attacks on a 15-year-old boy.
Lyle Mitsugi Nonaka, co-owner of Mitsu-Ken Okazuya & Catering in Kalihi, is accused of three counts of first-degree sex assault, one count of third-degree sex assault and one count of first-degree promotion of child abuse, in the grand jury indictment.
Nonaka was charged earlier this month with the same offenses but the indictment cancels the preliminary hearing scheduled Dec. 7 at District Court. Nonaka has been free on $150,000 bail since Nov. 3.
In an affidavit filed in District Court, the victim alleges he was assaulted at Nonaka's 'Ainanui Loop residence in September and October.
The victim told police he began e-mailing a "Shayna" he met online at www.MySpace.com in September and complied with Shayna's request for a nude photo.
Under threats the nude photo would be displayed, the victim said, he agreed to meet an Asian male at Shayna's request. The man was later identified as Nonaka.
Eric Seitz, Nonaka's attorney, said the indictment was not unexpected, but he declined further comment.
