The sentencing of convicted murderer Jerrico Lindsey was delayed today after Lindsey’s lawyer asked to withdraw from the case.
Lindsey, 28, was convicted in October of second-degree murder and other offenses in the May 14, 2007, shooting death of Benjamin Grajeda.
He faces a sentence of life in prison plus the possibility of decades of additional time behind bars.
Lindsey’s lawyer, William Harrison, asked to withdraw for the case today, saying his client wanted to file additional motions in the case but that another attorney would have to file them.
Circuit Judge Steven Alm warned Lindsey that ethical restrictions sometimes prevent lawyers from filing certain motions and there was no guarantee that a lawyer other than Harrison could or would file new legal papers on behalf of Lindsey.
Deputy Prosecutor Darrell Wong objected to a delay in the sentencing but Alm allowed Harrison to withdraw and set a new sentencing date in February.
Lindsey will be represented by a court-appointed defense lawyer.
Aided by two co-defendants, Lindsey abducted Grajeda from a Kaneohe home and locked him in the trunk of a getaway car following a botched robbery attempt.
When Grajeda escaped from the trunk as the car traveled on Kaneohe Bay Drive, Lindsey shot him multiple times as the victim fled down the middle of the road.
Area residents and other drivers witnessed the murder.
A Circuit Court jury convicted Lindsey of murder, burglary, robbery and kidnapping and decided that the offenses were not part of “continuing course of action,” making the defendant eligible for a life sentence plus multiple additional 20-year prison terms.
